Cumulus Coffee Machine Limited Warranty

1. Coverage

Cumulus Coffee ("Cumulus") warrants your Cumulus Coffee machine ("Machine"), purchased from Cumulus, against defects in the product materials and workmanship for a period of two (2) years from the original date of purchase.

2. Warranty Conditions

This limited warranty is provided only to the original purchaser and is non-transferable. To qualify for warranty service, the Machine must be purchased directly from the Cumulus Coffee website and only applies to purchases in the United States.  This limited warranty is part of, and incorporated with, the Cumulus Coffee Terms of Sale, to which you agree at the time of purchase on the Cumulus Coffee website.

3. What Is Covered

Under this warranty, Cumulus Coffee may, at our sole discretion, (i) repair or replace the Machine or parts of the Machine that prove defective due to improper materials or workmanship, under normal use and maintenance, or (ii) reimburse or refund your purchase, at the amount of the original purchase price, if repair or replacement is not practical. If a replacement is required, Cumulus Coffee may replace the Machine with a new or refurbished model of equal or greater value.  All exchanged or substituted parts and Products replaced under this warranty service will become the property of Cumulus Coffee.  Repaired or replaced products or parts will be warranted by Cumulus Coffee for the balance of the original limited warranty period or ninety (90) days from the date of the warranty service, whichever is longer, under the same terms as this original warranty.

This limited warranty is strictly limited to the repair, replacement, or reimbursement of any defective product or parts as set forth under the terms and conditions of this warranty.  Moreover, this limited warranty is only valid for Machines purchased and used in the United States; and does not extend to any Machine or products that is purchased in the United States and subsequently used or transferred outside of any jurisdiction in the United States. 

4. What Is Not Covered

This warranty does not cover:

  • Damage due to misuse, abuse, accident, or neglect (including failure to follow the operating instructions).
  • Damage caused by improper maintenance, cleaning, unauthorized repairs, or alterations to the machine (including removing any product markings).
  • Damage caused by the use of non-Cumulus Coffee accessories or consumables.
  • Machines used for commercial purposes or rental (including machines used in hotels, short-term rental properties, offices, restaurants, or other businesses).
  • Normal wear and tear, including cosmetic damage such as scratches, dents, or fading

 

This warranty shall be voided, and of no further force and effect, in each of the following circumstances:

 

  • Products used in an inconsistent manner or contrary to the use set forth in the product instructions, including products used with irregular voltage sources.
  • Products having been damaged by acts of nature, e.g., fire, flooding, lightning, acts of terrorism, etc.
  • Products having no proof of purchase or not having been purchased from Cumulus Coffee.
  • Products for which a reimbursement has been provided as a final remedy to a warranty claim.

 

5. How to Obtain Warranty Service or Make a Warranty Claim

To obtain warranty service, please contact Cumulus Coffee Customer Support at Support@cumuluscoffee.com.  You may be required to provide proof of purchase and details of the defect. Cumulus Coffee will guide you through the warranty process, which may include returning the Machine for inspection.  Shipping costs associated with warranty services will in most circumstances be paid for by Cumulus Coffee.

6. Limitation of Liability, Limitations of Remedies, and Warranty Disclaimers

Cumulus Coffee's liability is limited solely to the repair, replacement of the Machine under this warranty.  And Cumulus Coffee makes no express or implied representations or warranties, except as provided in this limited warranty directed to the Cumulus Machine. Cumulus Coffee, nor any of its officers, directors, agents, or employees, shall not be liable for any incidental, special, or consequential damages arising from the use or inability to use the Machine, or any other loss or damages arising out of the malfunction of the Cumulus Machine, or any other damages resulting from the use of the machine, even if Cumulus Coffee has been advised of the possibility of such damages.  Some jurisdictions do not allow for certain limitations or exclusions of liability.  These limitations set forth in this warranty apply to the greatest extent applicable in each jurisdiction where the Cumulus Machine is purchased, and if any provision is deemed unenforceable, for any reason, the remaining provisions of this warranty shall continue in full force.  

7. Extended Warranty

An extended warranty of up to three (3) years from the date of purchase is available for purchase within ninety (90) days of the original purchase. This extended warranty provides the same coverage as the standard warranty with the same terms and conditions as set forth in this original warranty. 

8. Governing Law

This limited warranty is governed by the laws of the State of Delaware, unless the laws of the state where the Cumulus Machine was purchased control.  This warranty gives you specific legal rights, and you may also have other rights that vary by state or country.

10.  YOUR ACKNOWLEDGEMENT AND UNDERSTANDING OF THESE TERMS:  By purchasing your Cumulus Machine through Cumulus Coffee, and accepting our Terms of Sale, you acknowledge that you are informed and aware of your rights and obligations under your local and applicable consumer laws governing the purchase of our product.  Through this warranty, Cumulus Coffee provides limited and specific rights in connection with your purchase.  You may have other applicable rights relating to the product and your purchase which may vary from jurisdiction to jurisdiction, and which may not necessarily be set forth here.   

 

9. Warranty Notice to California Residents Only

California law provides that for any warranty service for a product, California residents have the option of returning the product (a) to the retailer from which it was originally purchased, or (b) to another retailer that sells the same product, among other rights and consumer protections. Cumulus Coffee Products, including the Cumulus Machine, are only sold for direct purchase from Cumulus Coffee’s website, and as such, all warranty claims in California should be made through Cumulus Coffee, by contacting Cumulus Coffee Customer Support at Support@cumuluscoffee.com.
